From November 9, 2023, Australia’s unfair contract terms laws will significantly expand, impacting a broader range of contracts and businesses. Courts will gain the authority to impose substantial financial penalties on businesses and individuals for including unfair terms in their standard form contracts, and not just those who handle end consumer contracts. Wine industry suppliers who may have been unaffected or previously unconcerned due to the lack of severe penalties must now be vigilant and review their standard form contracts immediately to ensure they comply with the new requirements.
